DMCA Copyright Policy

Celestial Meridian, LLC (“Shio”) respects the intellectual-property rights of others and expects its users to do the same. We respond to clear notices of alleged copyright infringement under the Digital Millennium Copyright Act (“DMCA”). This policy describes how to submit a notice, how to file a counter-notice, and our policy on repeat infringers.

Reporting alleged infringement

If you believe content available through the Service infringes your copyright, send a written notice to our Designated Copyright Agent (below) that includes all of the following, as required by 17 U.S.C. § 512(c)(3):

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
  2. Identification of the copyrighted work claimed to have been infringed;
  3. Identification of the material that is claimed to be infringing, and information reasonably sufficient to let us locate it;
  4. Your contact information (name, address, telephone number, and email);
  5. A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law;
  6. A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

Our response

Upon receiving a complete notice, we will act expeditiously to remove or disable access to the material in question and will make a good-faith effort to notify the user who provided it.

Counter-notification

If you believe your material was removed by mistake or misidentification, you may send a counter-notice to our Designated Agent that includes:

  1. Your physical or electronic signature;
  2. Identification of the material that was removed and the location where it appeared before removal;
  3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification;
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court for your district (or, if outside the U.S., any district in which we may be found), and that you will accept service of process from the person who filed the original notice.

If we receive a valid counter-notice, we may restore the material in 10–14 business days unless the original complainant notifies us that they have filed a court action.

Repeat infringers

We maintain a record of DMCA notices and, in appropriate circumstances and at our discretion, will disable or terminate the accounts of users who are repeat infringers.

Misrepresentations

Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or was removed by mistake, may be liable for damages. Please do not make false claims.
